The following information provides a chronological and up-to-date record of Smith-Wilson & Deberry (plaintiffs) v. September 4, 2025 — Plaintiffs file a federal complaint in SDNY alleging race and gender discrimination, hostile work environment, and retaliation, and seeking relief under applicable federal, New York (NYCHRL/NYSHRL) and California laws.
September 18, 2025 — Plaintiffs file an Amended Complaint, adding allegations regarding continuing retaliation and pay inequity.
September 19, 2025 — Defendants file a Notice of Motion to Compel Arbitration and Stay the Action. The motion asks to move the case from public court to private arbitration and to pause the lawsuit pending that process. Defendants also request that plaintiffs pay their legal fees.
September 26, 2025 — Plaintiffs file a memorandum opposing defendants’ request for private arbitration. The brief explains that disputes involving sexual harassment may proceed in public court under the federal Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (EFAA). The opposition also references recent SDNY decisions indicating that when the EFAA applies, the entire case remains in court, including where alleged harassment consists of gender-based denigration rather than lewd or romantic conduct.
October 3, 2025 — Defendants file a reply in support of their motion to compel arbitration. The reply argues that the EFAA applies only where the alleged conduct is “sexualized” and, if the Court finds the EFAA protects only one plaintiff, asks to sever and compel the remaining plaintiff to arbitration. Defendants also request an award of attorneys’ fees and costs, and such other relief as the Court deems appropriate.
